A CARLISLE teenager who was given a youth rehabilitation order as a punishment for his offending has persuaded magistrates to extend his curfew to his back garden - so he can smoke cigarettes.
The 17-year-old, who can not be named for legal reasons, had earlier admitted illegally possessing a CS spray device.
He was sentenced to intensive supervision and surveillance on December 10 at the city's Rickergate Youth Court.
This included a three-month nightly curfew to the property where the youth lives but not its garden.
The restriction - monitored with an electronic tag - runs from 7pm to 7am each day.
After considering the case, magistrates agreed that the teenager's curfew boundary will now include his home's back garden "to allow the defendant to smoke."
