AN EDEN Valley motorist is facing a trial at Carlisle's Magistrates' Court over an allegation that he was 'in charge' of a car while over the drink-drive limit.
Thomas Gilbert Hine, 57, of Great Strickland, is accused of committing the offence on November 13 as he sat in his Toyota Hilux in Market Court, Penrith. The prosecution say that at the time the defendant had 62mcg of alcohol in 100mls of breath.
The legal limit for driving - though that is not the offence alleged - is 35mcg. The charge states that the defendant was found 'sitting in his vehicle with the keys to his car.'
He has pleaded not guilty, indicating that he had no intention of driving or using the car.
At Carlisle's Rickergate court, District Judge John Temperley adjourned the case until January 28 for a trial.
