Magistrates agreed to alter a woman's curfew conditions - so she could have a cigarette.

Yvonne Shearer, 57, of Anchor Close, Penrith, appealed to magistrates in Carlisle to allow her to leave her house, something which her electronic tag banned.

The smoker was sentenced to a nighttime curfew, from 7pm to 7am, for six weeks in relation to a common assault. The curfew prevented her from leaving her house.

Shearer told magistrates her family don't like her smoking inside. When asked why she couldn't simply smoke out of her window, she told them the smoke lingers and re-enters the house.

After some deliberation, magistrates agreed to vary the order to allow Shearer to smoke outside the house, as long as she does not go further than 2m from the back door of the house.
